Currently in Connecticut, there is no cap on damage awards in medical malpractice cases. There is a modified comparative negligence rule in place. In Connecticut, medical malpractice claims must normally be brought within 2 years from the date of injury or discovery of the negligent act. However, Connecticut also has a statute of repose, which places a three-year absolute deadline on medical malpractice claims regardless of discovery date. Connecticut is unusual in that it does not have a separate statute of limitations for minors.
